Why this matters now
The EU Pay Transparency Directive (EU 2023/970) introduces new legal requirements for employers across the EU. From 7 June 2026, organisations must be able to explain pay decisions clearly and consistently - including pay ranges, the criteria used, and how job value is assessed.

What is the EU Pay Transparency Directive?

The EU Pay Transparency Directive (EU 2023/970) is an EU law designed to reduce unjustified pay differences and strengthen equal pay for equal work.

It introduces new obligations for employers to be more transparent about pay, including how pay is set, how roles are valued, and how differences can be explained. In practice, this means organisations must be able to clearly justify pay decisions using objective criteria, rather than informal or ad-hoc approaches.

Who must comply and when?

The Directive applies to all employers in the EU, regardless of size, although obligations increase for larger organisations.

• EU Member States must transpose the Directive into national law by 7 June 2026
• From that point, employers must be ready to meet the transparency and reporting requirements set out in local legislation

Organisations that prepare early will be better placed to respond to employee requests, audits, and reporting obligations.

What data must employers provide?

Under the Directive, employers may be required to:
• Share pay ranges for roles before recruitment or interviews
• Explain the criteria used to determine pay and progression
• Respond to employee requests for information about their own pay level and average pay levels for comparable roles
• Report on pay gaps, particularly where unjustified differences are identified

This data must be objective, consistent, and explainable.
